Kioku — Terms of Service

1. About the Service

Kioku is an AI-powered knowledge management application that helps you capture, organize, and retrieve personal knowledge. The app uses on-device AI models for processing and supports features including note capture, AI-powered retrieval, and spaced repetition learning.

2. Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) and able to form a legally binding contract to use the Service.

3. Your Content

You retain full ownership of all content you create in Kioku (notes, voice memos, text entries). We do not claim any rights over your content. Your content is stored locally on your device and, if you enable cloud sync, in encrypted cloud storage that only you can access.

4. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the app.
• Use the Service to violate any law or regulation.
• Attempt to bypass any security features or access restrictions.
• Distribute the app or any part of it without permission.

5. AI Features

Kioku uses on-device AI models to provide knowledge retrieval and learning features. AI-generated responses are based on your personal knowledge base and may not always be accurate. You are responsible for verifying any information provided by the AI features.

6. Subscriptions & Payments

Some features may require a paid subscription. Subscriptions are billed through the Apple App Store or Google Play Store and are subject to their respective terms. You can manage or cancel your subscription through your device's app store settings.

7. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We are not responsible for any data loss resulting from device failure, app deletion, or other causes outside our control. We recommend regular exports of your data.

8. Limitation of Liability

To the maximum extent permitted by law, Kai Kang / Coding Collie will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability will not exceed the amount you paid for the Service in the 12 months prior to the claim (or $100 if nothing was paid).

9. Termination

You may stop using the Service at any time by deleting the app. We may suspend or terminate access if you violate these Terms. Upon termination, your locally stored data remains on your device.

10. Changes

We may update these Terms from time to time. We will update the "Last updated" date and may notify you through the app. Continued use after changes means you accept the updated Terms.
